We, Youpik Pte., Ltd (hereinafter referred to as “Company”, “Uchoice pro”, “we”, “us”, “our” or “ours” depending on the context) take the protection of your personal data and other data related to your seriously (collectively referred to as “Data”), in connection to use our mobile application (collectively referred to as “Platform” or “Service”). So, we’ve set out this privacy policy to inform you about our processing and protecting of personal data that collected, used, and disclosed by us in accordance with personal data protection law and related regulations. Please read this Privacy Policy carefully before accepting or consenting us to collect, use and disclose (collectively referred to as “process” or “processing”) your personal data which is available at Uchoice pro registration pages, you acknowledge that you have read and understood the terms of this Privacy Policy and by clicking agree or consent the processing of your personal data shall be subjected to the terms herein.


Introduction

This Privacy Policy exists to keep you in the know about how to process the personal data we collect and receive during the course of providing the Service or access to the Platform to the person who receives the Service (collectively referred to as “useror “you) including the employees of the Company. We will only collect, use, disclose, store and/or process your personal data under this Privacy Policy. Unless specified to be used only for any specific person.


This Privacy Policy applies in conjunction with other notices, contractual clauses, and other consent terms that apply in relation to the collection, storage, use, disclosure, and/or processing of your personal data by us and is not intended to override them unless we state expressly otherwise.


  1. Collecting of Personal Data

Personal data” means any information relating to a person, which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased persons in particular, according to the personal data Protection Act, B.E. 2562 (2019) including any amendments in the future.

We will only collect your personal data for the purposes specified in this Privacy Policy or as permitted by law. We will cease to collect your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such collecting no longer serves the purposes for which the personal data was collected, and is no longer necessary for any legal purpose.

During the course of your use of the Platform and the provision of the Service, we may collect personal data about you, as follows:


        1. Identity data, such as your name, surname, gender, profile picture, date of birth, job title, the business type, nationality, residential, marital status, government issued identification (e.g. identification card number, social security number, passport number, tax ID number, driving license details or similar identifiers), immigration details such as the date of arrival and departure, signature, sound, audio recording, photo, facial features for recognition, workplace, education, insurance details, license plate details, house registration, household income, monthly salary and personal income, and other identity data provided by you;

        2. Contact data, such as delivery address, email address, phone numbers, Line ID, Facebook account and ID, Google ID, Apple ID, Twitter ID, Tiktok Account and other ID from social networking websites, contact data of your contact person (e.g. phone numbers), other contact data (e.g. written communication with you) and any contact data provided by you;

        3. Biometric data such as the audio files when you use our voice search engine and your face including other parts of the body and voice of yours and/or any other person.

        4. Account data, such as bank account details, credit card details, and payment details (e.g. debit/credit card or bank information, debit/credit card number, type of credit card, issue and expiry date, payment information, bank account details, the details of payment records, regarding you risk profile information for the business partner, the rating of credit and debt repayment, information according to the declaration of suitability, account data that may be collected directly by our affiliates and/or third party payment service providers) and other financial data;

        5. Transaction data, such as details about orders and products list, and other details of products and services related to you;

        6. Technical data, such as Internet protocol (IP) address, your login data, browser type, and version, time zone setting and location, browser plug-in types and versions, operating system and platform, international mobile equipment identity, device identifier, IMEI, MAC address, cookies (where applicable) and other information and technology on the devices you use to access the Platform;

        7. Profile data, such as your username and password, PIN number, Single Sign-on (SSO ID) data, OTP password, computer traffic data, geotagging, and orders related to you, your interests, preferences, feedback, and survey responses;

        8. Usage data, such as information on how you use the Platform, using behaviors, browsing history (information of products and services or viewing any content on the Platform, including the time spent on the Platform, items, and data searched for on the Platform, access times, and dates, as well as websites you were visiting before you came to the Platform and other similar statistics), cookies, similar technologies, device ID, device’s type, connection details, Browser information, the language used, operating system used, etc.

        9. Location data when you store photos and share your location to us in the form of images or videos and have uploaded such content on the Platform.

        10. Marketing and communications data, such as your preferences in receiving marketing from us and our third parties, your communication preferences and your chat, email or call history on the Platform or with third party customer service providers.

        11. Additional Data, we may request you to provide the additional data for identity verification (such as the document copy of the identity verification is issued by the government) or if we assume that you violate our Privacy Policy or Terms of Use.

  1. Use and Disclosure of Your Personal Data

    1. Purpose of Use

  1. We may use your personal data for certain purposes, as follows:

          • To process orders you submitted through the Platform;

          • To deliver the products you have purchased through the Platform. We may pass your personal data to a third party (e.g. our logistics partner) or relevant regulatory authority (e.g. customs) in order to make delivery of the product to you;

          • To update you on the delivery of the products;

          • To provide customer support for your orders; and

          • To verify and carry out payment transactions (including any credit card payments, bank transfers, offline payments, remittances, or e-wallet transactions). In order to verify and carry out such payment transactions, personal data will be transferred to third parties such as our payment service providers.

        1. Providing Service

          • To facilitate your use of the Service or access to the Platform;

          • To administer your account;

          • To display your username or user profile on the Platform (including on any reviews you may post);

          • To facilitate using the sub-application on the Platform;

          • To respond to your queries, feedback, claims or disputes, whether directly or through our third party service providers;

        2. Marketing and advertising

          • To provide you with information we think you may find useful or which you have requested from us (provided you have opted to receive such information);

          • To send you marketing or promotional information about our or third-party sellers’ products and services on our Platform from time to time (provided you have opted to receive such information);

          • To help us conduct behavior marketing and advertising; and

          • To promote the Service and use information that you give to us, such as user-generated content (including video content) that you uploaded or broadcasted on our Platform and will be accessible on the Internet and may be shared by the public (the latter of which is not within our control), as part of our advertising and marketing campaigns to promote the Platform.

        3. Legal and operational purposes

          • To ascertain your identity in connection with fraud detection purposes;

          • To compare and examine the information with a third party to assure that is true data;

          • To process any complaints, feedback, enforcement action and take-down requests in relation to any content you have uploaded to the Platform;

          • To collect the statistics and research for internal use and reporting, and/or collecting data as required under the law;

          • To collect in the system and reserve the data according to Uchoice pro’s Policy for establishing the legal claim or process legal claim;

          • To prevent or investigate the violation of Terms of Use or Privacy Policy, corruption, illegal acts, omission of action, or any offenses that occur or are suspected to have occurred, either related to using service or regarding any reasons, which arise because of the relationship between you and us or not whether;

          • To conduct the due diligences;

          • To comply with legal and regulatory requirements (including, where applicable, the display of your name, contact details and company details), including any law enforcement requests, in connection with any legal proceedings, or otherwise deemed necessary by us; and

          • To prevent any dangers to life health and safety (if necessary).

        4. Analytics, research, business and development

          • To understand your user experience with the Service and the Platform;

          • To improve the layout or content of the pages of the Platform and customize them for users;

          • To conduct surveys, including carrying out research on our users’ demographics and behavior;

          • To improve our current technology (e.g. voice recognition tech, etc.) via machine learning or other means;

          • To derive further attributes relating to you based on personal data provided by you (whether to us or third parties), in order to provide you with more targeted and/or relevant information;

          • To conduct data analysis, testing and research, monitoring and analyzing usage and activity trends; and

          • To further develop our Service;

    1. We may collect your personal data from you in the situations, as follows:

      1. When you use Platform;

      2. When you create an account with us;

      3. When you list products and/or services through the Platform or third party service providers;

      4. When you apply for, subscribe to or otherwise use any of the Service;

      5. When you make a transaction regarding the products available on the Platform;

      6. When you use any of the features, functions or mini-apps available on the Platform;

      7. When you record any user-generated content which is uploaded on the Platform, including account information or content of affiliates or third party service providers;

      8. When you use the chat function on the Platform;

      9. When you subscribe to our publications or marketing collaterals;

      10. When you enter a competition, promotion or survey;

      11. When you participate in any activity or campaign on the Platform;

      12. When you log in to your account on the Platform or otherwise interact with us via an external service or application, such as Facebook or Google or Youpik Ultimate;

      13. When any other user of the Platform posts any comments on the content you have uploaded on the Platform or when you post any comments on other users’ content uploaded to the Platform;

      14. When a third party lodges a complaint against you or the content you have posted on the Platform; and

      15. When you interact with us offline, including when you interact with our outsourced customer service agents.

    2. We may collect Personal Data directly in the service channel, such as sign up, registering, signing contracts and documents, completing surveys, or using other products, services, or service channels controlled by the Company, or when the subject of personal data communicates with the Company at the office or through other contact channels supervised by the Company.

    3. We may collect personal data from you, third parties (including but not limited to, agents, vendors, contractors, partners and any others who provide services to us, who collect your personal data and/or perform functions on our behalf, or with whom we collaborate, including but not limited to payment service providers, government sources of data, financial providers, credit bureaus, delivery, marketing and other service partners), our affiliates, or such data may be collected automatically when you use the Platform or the Services, as set out in this section. See also section 9 below on the collection of computer data.

Where we collect personal data from third parties and/or our affiliates, we will only collect your personal data, where permitted by law, for or in connection with the purposes for which those third parties or our affiliates are engaged, for the purposes of our collaboration with the third parties or affiliates, or for the requirement to carry out verification or due diligence checks. You agree that you have provided your consent (whether to us, the third party or our affiliates) to the transfer of your personal data from third parties and/or our affiliates to us for the purposes set out in this Privacy Policy or any other terms.

    1. We will only be able to collect certain categories of personal data if you voluntarily provide the personal data. If you choose not to provide your personal data to us or subsequently withdraw your consent to our use of your personal data, we may not be able to provide you with certain features or functionality on the Service or access to the Platform.

    2. You must submit personal data which is accurate and not misleading and you must keep it up to date and inform us of any changes to the personal data you have provided to us. We shall have the right to request documentation and carry out the necessary checks to verify the personal data provided by you as part of our user verification processes or as required under the law.

If you provide personal data of any third party to us, you represent and warrant that you have obtained the necessary consent, license and permissions from that third party to share and transfer his/her personal data to us, and for us to collect, store, use and disclose that data in accordance with this Privacy Policy.

If you sign up to be a user on our Platform using your social media account or link your user account to your social media account or use certain other our social media features, we may access personal data about you which you have voluntarily provided to your social media provider in accordance with the provider's policies and we will manage your personal data in accordance with this Privacy Policy.


  1. Collection of Computer Data

    1. We or our authorized service providers may use cookies, web beacons, and other similar technologies in connection with your use of the Service or access to the Platform.

    2. When you visit the Platform through your computer, mobile device, or any other device with internet connectivity, our company servers will automatically record data that your browser sends whenever you visit a website, such as the technical data and usage data outlined in Section 2 above.

    3. Cookies are small text files (typically made up of letters and numbers) placed in the memory of your browser or device when you visit a website or view a message. They allow us to recognize a particular device or browser. Web beacons are small graphic images that may be included on our Service and the Platform. They allow us to count users who have viewed these pages so that we can better understand your preference and interests.

    4. You may be able to manage and delete cookies through your browser or device settings. However, certain cookies are required to enable core functionality (such as adding items to your shopping basket), so please note that changing and deleting cookies may affect the functionality available on the Platform or through our Service.


  1. Your Right

You may have rights regarding the processing of your personal data, including:

    1. To withdraw consents you have given for the processing of your personal data.

Please be informed that if you withdraw your consent of the processing of your personal data, we may not be able to provide certain or all of our Service to you or perform any contract we have with you, and we will not be liable in the event that we do not continue to provide the Service to, or perform our contract with you. Our legal rights and remedies are expressly reserved in such an event. However, the withdrawal of consent will not affect the lawfulness of the collection, use and/or disclosure of your personal data based on your consent before it was withdrawn;

    1. To request to access or get a copy of your personal data or to request the disclosure of the acquisition of the personal data obtained without your consent;

    2. To request to update, complete and not misleading of personal data;

    3. To request to erase or destroy Personal Data, or anonymize the personal data to become anonymous where permitted by law;

    4. To request to restrict the use of personal data where permitted by law;

    5. To request the transfer of personal data to a third party data controller where permitted by law; and

    6. To request to restrict the use of personal data, in accordance with laws.

You can exercise your rights by setting on our Platform, by unsubscribing from our email, or by sending us an email using our form in writing and contacting us via contact details below. We will process such information received and answer your request within 7 working days. Where permissible under law, we may refuse such request.

If you wish to exercise your right against us to disclose your Personal Data that cannot be confirmed in our Services, correct or delete your Personal Data that is contrary to facts, notify you of the purpose of use of your Personal Data, or other rights permitted under Applicable Laws, you may contact us using the Request Form. By that you shall select the application menu ‘Account’, ‘Setting’, ‘About’, ‘Privacy Policy’, then finally press ‘Request to Withdraw’ button to submit the Request Form.

7.8. If you wish to delete your account from the Application, you shall process with going to your profile and going to select “Account Deactivate”. Even if you processed to deactivate your profile, you will not be able to re-activate your account again. Therefore, once you already deactivated your profile, your personal data will be deleted along with your profile.

However, you are able to reactivate by with the subscription by making a new subscription with your old information. Therefore, Uchoice pro will use, keep, collect and process your personal data which you have subscripted latest.


  1. Who We Disclose Your Personal Data To

    1. We may disclose (or permit the disclosing of) your personal data with and/or transfer your personal data to third parties and/or our affiliates for the above-mentioned purposes. These third parties and affiliates, which may be located inside or outside your jurisdiction, include but are not limited to:

        1. Service providers (such as agents, vendors, contractors and partners) in areas such as payment services, logistics and shipping, marketing, data analytics, market or consumer research, survey, social media, customer service, installation services, information technology and website hosting;

        2. Their service providers; and

        3. Other users of the Platform or service users;

        4. Government authorities or other legal organizations to comply with laws, orders, requests, to coordinate with the government sector relating to comply with laws.

    2. In disclosing your personal data to them, we endeavor to ensure that the third parties and our affiliates keep your personal data secure from unauthorized access, collection, use, disclosure, processing or similar risks and retain your personal data only for as long as your personal data is needed to achieve the above-mentioned purposes.

    3. We may also share personal data in connection with any proposed purchase, merger or acquisition of any part of our business, provided that we satisfy the requirements of applicable data protection law when disclosing your personal data.

    4. We may share your personal data with our third party service providers or affiliates (e.g. payment service providers) in order for them to offer services to you other than those related to your use of the Platform or our Service. Your acceptance and use of the third party service provider’s or our affiliate’s services shall be subject to terms and conditions as may be agreed between you and the third party service provider or our affiliate. Upon your acceptance of the third party service provider’s or our affiliate’s service offering, the collection, use, disclosure, storage, transfer and processing of your personal data shall be subject to the applicable privacy policy of the third party service provider or our affiliate, which shall be the data controller of such data. You agree that any queries or complaints relating to your acceptance or use of the third party service provider’s or our affiliate’s services shall be directed to the party named in the applicable privacy policy.

We will retain your personal data for as long as you have Uchoice pro’s account, or we maintain an ongoing, or relationship with you, or as necessary in connection with the purposes set out in this Privacy Policy. We may retain your personal data for such additional time after termination of your account or our relationship as required or permitted to by law, provided that we will appropriately maintain the security of retention of personal data and be in accordance with laws. However, in some cases, we may have to retain the personal data even after the expiration of the laws period or limit, such as in the case of litigation or legal proceedings, etc.
